C09.0 Parking Appeals Board
APPEALING A PARKING OR TRAFFIC CITATION
Anyone who has a valid reason to contest a citation may do so in one of the following ways:
Make an appointment to meet with the university parking appeals administrator at the Parking and Transportation Services Office in Grace Watson Hall;
Mail a completed appeal form or letter to the appeals administrator;
Send an e-mail appeal to the appeals administrator.
The appeals administrator's decision is based on the following criteria:
Accuracy of the information presented
Consideration of any extenuating circumstances
Previous parking record at RIT
If the appellant does not agree with the university parking appeals administrator, the appeal may be taken to the Parking Appeals Board. The appellant must indicate this intent to the appeals administrator within seven days of the original decision. The appeals administrator will contact the chair person of the Parking Appeals Board to arrange an appointment with the Board.
ARTICLE I - DUTIES AND POWERS
This board will be the authorized body by which members of the RIT community, persons doing business with the university, and visitors may continue the appeal process in the event that the original appeal through the university parking appeals administrator is denied or unsatisfactory, and through which moving violations may be appealed. The Parking Appeals Board will report to the director of Parking and Transportation.
ARTICLE II - PURPOSE AND FUNCTION
The purpose and function of the RIT Parking Appeals Board is:
To provide a fair hearing and decision for students, faculty, staff, visitors and vendors regarding alleged parking and traffic violations that were not resolved at the university parking appeals administrator's level.
To carry out all functions as specified in the By-laws.
ARTICLE III - MEMBERSHIP
The Parking Appeals Board will consist of seven members. Three of these will be students appointed by the president of the Student Government, two will be faculty members appointed by the chairperson of the Academic Senate, and two will be staff members appointed by the chair of Staff Council. Terms of office are for one calendar year. Members may be reappointed, but may not serve more than two consecutive terms. All members must be in good standing with the university community. Students must present a valid RIT ID card to the chairperson at the beginning of every academic term, and all members must have a letter of appointment from their original appointing authority. There will be at least one designated alternate for each of faculty, staff and student membership classes who has been approved by the original appointing authority.
ARTICLE IV - OFFICERS
The Parking Appeals Board will have a chairperson, a vice-chairperson, and a recording secretary. Student representatives may not hold the position of chairperson.
ARTICLE V - DECISIONS
In order to reach a decision, a quorum of Board members must be present.
Appellants dissatisfied with the decision of the Parking Appeals Board may take the matter up with the Office of Parking and Transportation. The board may not re-open a case once a decision has been reached.
ARTICLE VI - APPEALS
As a hearing/appeals body, the RIT/Parking Appeals Board may:
Rescind the original fine and/or penalty on a traffic citation. In such cases, the citation will be stricken from the record.
Uphold the original fine and/or penalty.
Reduce the original fine and/or penalty. In such cases, the citation will remain on the record.
Rescind an individual's driving and/or parking privileges on the RIT campus.
Refer a case to the Institute Appeals Board together with a recommendation for further action. The Institute Appeals Board may either uphold the decision of the Parking Appeals Board, or hear the appeal and render its own decision.
Make additional recommendations to appropriate administrative personnel.
No further sanctions are available to the Parking Appeals Board.
