New Legislation Positively Impacts Charitable Giving

The Secure Act 2.0 was recently signed into law. It includes three notable changes for those age 70 ' or older:

  • Tax-free gifts from IRAs - also known as Qualified Charitable Distributions (QCDs) - can now be used to create life income gifts (Charitable Gift Annuities and Charitable Remainder Trusts). This is a one-time opportunity for donors and is subject to a maximum limit.
  • The maximum contribution cap for QCDs that has been in place for well over a decade will finally increase annually for inflation. This will provide donors with additional funds for tax-free giving.
  • In 2023, the Required Minimum Distribution (RMD) age increased from 72 to 73. Individuals will have more time for tax-free savings.
